Electronic Signature Terms for Signers

These Electronic Signature Terms (“eSignature Terms”) apply whenever you sign an agreement on Easier Exchange, whether you set the exchange up or were invited to it. By drawing or typing your signature and checking the agreement box, you accept these eSignature Terms. Please read them carefully: they set out what you can expect from us when you sign electronically, and what we expect from you.
1. Scope and consent to electronic records
By using Easier Exchange, you consent to transact electronically under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act (UETA). Your consent covers the underlying agreement, any counter-proposals or amendments, and every handoff confirmation receipt generated under it. You may withdraw your consent only by ending or cancelling the exchange in the app; withdrawal of consent is not retroactive and does not affect the validity of agreements or handoff confirmations already executed.
2. Hardware and software requirements
To access, review, sign, and retain agreements and receipts, you must have: (a) a device with an internet connection; (b) a modern web browser that supports standard web forms and cookies; (c) the ability to view, download, and store PDF documents; and (d) an active, authenticated Google account whose address matches the email designated for the exchange.
3. Paper copies and retention
Easier Exchange provides all documents in electronic form only and does not mail or provide paper copies. You may view and download your signed agreement and every handoff receipt as a PDF directly from your dashboard at any time while the exchange exists. You should download and retain your own permanent copies of all PDFs and receipts.
4. Easier Exchange is not a party to your agreement
An agreement signed on Easier Exchange is a bilateral contract binding only the two people who signed it. Easier Exchange is not a party to your agreement, is not responsible for either party's performance, does not supervise handoffs, and takes no position on its terms. Easier Exchange does not provide legal advice or create an attorney-client relationship. By signing, you release Easier Exchange, its operators, and its service providers from any claims arising out of or related to your agreement or exchange.
5. Identity, legal capacity, and authority
Before you sign, confirm who sent you the invitation. By signing, you represent and warrant that you are at least 18 years old, possess legal capacity to enter into binding agreements, are authenticated under your own Google account, and are authorized to act. Signing on behalf of another person or third-party entity is not supported.
6. Court orders control (children)
A handoff agreement on Easier Exchange regarding a child is a scheduling and logistics agreement between two people. It does not create, transfer or modify custody, parenting time, visitation, or child support, and it does not modify any court order or parenting plan. If anything in your agreement conflicts with a court order or parenting plan, that court order or parenting plan controls. The court of competent jurisdiction retains exclusive authority over custody matters. You confirm that your exchange arrangement is consistent with any applicable court orders.
7. Agreements are not an admission
Agreements and handoff receipts on Easier Exchange record practical logistics and contemporaneous handoff confirmations only. The parties agree that neither the agreement, the schedule, nor any receipt generated under it constitutes an admission of any fact, fault, ownership, or legal position, nor evidence of primary caretaker status, parental fitness, availability, means, waiver, or acquiescence in any custody, divorce, separation, dissolution, or property-division proceeding. The platform takes no position in any dispute and will not characterize records for either side.
8. Permanent transfers are irrevocable
A permanent transfer agreement permanently and irrevocably transfers all right, title, interest, and responsibility in a pet. It cannot be reversed in the app once executed and physically performed. Notice: A one-time pet handoff created without a return date constitutes a permanent transfer of ownership upon physical completion. All disputes regarding ownership are strictly between the parties.
9. Signature information and audit trail visibility
When you sign, Easier Exchange captures an electronic image of your signature (drawn or typed) along with your authenticated Google name, email, Google UID, IP address, user-agent string, UTC timestamp, and a SHA-256 cryptographic digest of the signature image. This tamper-evident audit record appears on the executed PDF and in the exchange record. Your counterparty and anyone with whom the document is shared can see this audit data. Phone numbers are released between counterparties only after both parties have signed.
10. Evidentiary effect of handoff receipts
Mutual in-app confirmation of a handoff constitutes the parties' agreed contemporaneous electronic record that a physical handoff occurred and when it occurred. The parties consent to the use of handoff receipts as authentic evidence of whether and when a handoff occurred, and agree that receipts do not determine or evidence either party's underlying legal rights.
11. Document retention policy
Executed agreements, history logs, and handoff receipts are maintained in the platform's secure datastore for as long as your exchange remains on file. Either party may download copies at any time. When an exchange is ended or cancelled, existing completed handoff receipts and executed PDFs remain archived for the parties' records.
